Contrac® warrants its products to be free from defects in material or workmanship for 5 years (Vitreous China) and 1 year (Parts and Fittings) from the date of purchase by the original purchaser.
If inspection of this plumbing product within 5 years (china product) or 1 year (parts and fittings) after its initial purchase confirms that it is defective in materials or workmanship, Contrac® will repair or, at its option, exchange the product for a similar model.
Contrac® provides no warranties or guarantees beyond those in this Limited Contrac® Warranty. This limited warranty applies only to the original purchaser and installation of these products. All de-installation, re-installation, and transportation costs or charges incidental to warranty services are to be borne by the owner. In no event will Contrac® be liable for the cost of repair or replacement of any installation materials, including but not limited to tiles and marble.
Contrac® will not be responsible for, and this warranty does not cover, any liability to the purchaser or any third party for consequential or incidental damages, all of which are hereby expressly disclaimed. The warranty does not extend beyond the duration of this warranty for any implied warranties, including those of merchantability or fitness for an intended purpose.
This warranty does not apply to local building code compliance. Since local building codes vary considerably, the purchaser of this product should check with a local building or plumbing contractor to ensure local code compliance before installation.
Contrac® shall not be responsible or liable for any failure or damage to its toilet tank trim, plumbing fittings, or china products caused by the use of chloramines or high concentrations of chlorine, lime/iron sediments, and/or other minerals not removed from public water during the treatment of public water supplies, or caused by toilet tank-type cleaners containing chlorine, calcium hypochlorite, and/or other chemicals.
This warranty is void if the product has been moved from its initial place of installation, subjected to faulty maintenance, abuse, misuse, accident, or other damages, not installed in accordance with Contrac® instructions, or modified in a manner inconsistent with the product as shipped by Contrac®.
NOTE: Some states or provinces do not allow limitations on an implied warranty, and some states/provinces do not allow exclusions or limitations regarding incidental or consequential damages, so the above limitations may not apply to you. This warranty gives you specific legal rights, and you may have other rights, which vary from state to state or province to province. No person is authorized to change, add to, or create any warranty or obligation other than that set forth herein.
Contrac® (Warrantor) warrants to the original consumer/purchaser only, that all products manufactured or supplied by the warrantor will be free from defects in material and workmanship under normal use and service for the period of one (1) year from the date of purchase.
This warranty does not cover any damage resulting from normal wear, accident, misuse, lack of reasonable and necessary repair, or alterations or modifications in the unit when the product is installed.
In the event of a warranted product defect, please contact our customer service department with a copy of your proof of purchase for review and determination of the possible replacement with a functionally equivalent product at the warrantor’s expense. However, you shall bear all other expenses, including, but not limited to: cost of removal, transportation, re-installation, communication, and any special service requested by you, such as overtime labor. Replacement items carry only the unexpired portion of the original warranty.
Except to the extent prohibited by applicable law, all implied warranties, including warranties of merchantability and fitness for a particular purpose, are limited in duration to the shorter of the period provided by law or the period of this warranty. Under no circumstances shall Contrac® be liable for incidental or consequential damages sustained in connection with the product. The express warranty above constitutes the entire warranty and is in lieu of all other expressed or implied warranties.
Some states or provinces do not allow the exclusion or limitation of incidental or consequential damages, or limitation on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state or province to province.
Contrac® (Warrantor), warrants to the original purchaser that this Shower Wall System kit will be free of manufacturing defects, which affect its performance as a bathing or showering fixture, under the following conditions and subject to the limitations contained in the “Remedies” and “Warranty Limitations” sections.

The Limited Warranty applies for 10 years from the date of purchase if the fixture is used in a residential owner-occupied building for non- commercial purposes; or for 2 years from the date of purchase if it is used in any other building, including any building used for rental, commercial, or business purposes.
REMEDIES:
The original purchaser’s remedy under this Limited Warranty is limited to the repair, replacement, or refund of the purchase price of the fixture, at FGI Industries, Ltd. sole option, of any part of the fixture which has failed or does not conform to the manufacturer’s specifications.
In no event shall FGI Industries, Ltd. be liable for lost profits, loss of use, incidental, special or consequential damages including, but not limited to, damage to or loss of use of the building or its contents, arising out of any defect in the fixture; nor shall FGI Industries, Ltd. be liable for any amount in excess of the original purchase price of the fixture.
FGI Industries, Ltd. reserves the right to require the return, at purchaser’s expense, of the damaged fixture for repair or exchange before providing services under this Limited Warranty. If FGI Industries, Ltd. elects to replace the fixture, its obligation is limited to supplying a replacement unit or component part of comparable size and style, and does not include the cost of removal, installation, or transportation, which must be borne by the purchaser.
Replacement parts provided under this Limited Warranty are warranted for the remainder of the original warranty period applicable to the fixture, as if such parts were original components of that fixture.
WARRANTY LIMITATIONS:
THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED. FGI INDUSTRIES, LTD. DISCLAIMS ANY AND ALL LIABILITY FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES. Some states or provinces do not allow limitations of incidental or consequential damages, so the above limitations and exclusions may not apply to you. In such states or provinces, FGI Industries, Ltd. liability shall be limited to the extent permitted by state or provincial law. ANY IMPLIED WARRANTIES ARISING BY WAY OF STATE OR PROVINCIAL LAW, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION AND IN SCOPE OF COVERAGE TO THE TERMS OF THIS LIMITED WARRANTY, UNLESS A SHORTER PERIOD IS ALLOWED BY LAW.
